Arbitration and Class Action Waiver

The arbitrator may grant any relief that a court could, including injunctive and declaratory relief, but may not consolidate claims or conduct class proceedings. This agreement to arbitrate is intended to be broadly interpreted.

You and the Company agree to waive any rights to a jury trial or to participate in a class action or class arbitration. Claims must be brought in an individual capacity only and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

If any portion of this arbitration provision is found to be unenforceable, the remaining portions shall remain in full force and effect. If your dispute is deemed outside the scope of this arbitration agreement, then you agree that such dispute shall be brought exclusively in the state or federal courts located in Los Angeles, California.

You have the right to opt out of this arbitration agreement within thirty (30) days of first accepting these Terms of Service. To opt out, you must send a written notice to support@hippy-trippy.com stating your intent to opt out of arbitration.
